Your Community is Considering New Regulations that could Impact Your Dairy Farm

Communities across the state are seeing an increase in discussions around “Operation Ordinances” at the town and county levels. These proposed regulations could have significant impacts on your dairy farm, including new fees, oversight requirements and operational changes. 

What is an "Operation Ordinance"?

Doesn’t just impact CAFOs

While many towns are discussing the ordinance at 1,000 animal units (CAFO), some towns and counties have set the limit at 500 or 700au.

Fees per animal unit

Some ordinances have a “$3 per animal unit” fee for spreading manure in that town, regardless of the amount of acres the farm is spreading on. 

Additional requirements

Ordinances may address areas like biosecurity, animal care and worker safety, without recognizing existing programs like FARM. 

Water testing and liability

Many ordinances require annual well testing within a certain radius around the operation, and the farm is responsible for all costs associated with the tests and remediation. 

Length and complexity

Some ordinances are lengthy (over 100 pages) and can be challenging for farmers to navigate without support.
